Article 19 of the Representation of the People Act, 1950 entitles every person who is 18 years of age as on 1st January of the year for which the electoral roll is prepared to be registered as a voter in the constituency where he or she ordinarily resides. This implies that the very first requirement for resident Indians to be eligible voters is to be registered on the electoral roll of their constituency. It is the responsibility of every resident Indian citizen to get him/herself registered as a voter.
HOW TO REGISTER?
An individual (an ordinary resident Indian citizen) who has never been registered previously but has been left out of the electoral rolls can register by applying in Form-6.
An individual who shifted place of residence (for employment / education / or other reasons) needs to get his/her name deleted from the place where he/she earlier resided, and get it included at the new place. For this, the individual needs to file claim application in Form-6 before the Electoral Registration Officer of the new place and in that application give the full address of the earlier place of residence.
To modify particulars such as name, house number, middle name, last name, age, sex, EPIC number etc. in the electoral roll a claim in Form-8 can be filed.
It should be noted that every Indian citizen can be a registered voter only at one place. Registration in more than one place is an offence.
Other Important Facts
As per the law, an Indian citizen’s name can be registered up to the last date of filing nominations by candidates as notified by the Election Commission for any general election or bye-election to an Assembly or Parliament. To provide the Electoral Registration Officer with a sufficient window of opportunity to take action, apply at least ten days before the last date of making nominations. There is a mandatory period of seven days (from the application by an individual to be included in the electoral rolls) during which an objection notice can be made by any registered voter towards the inclusion of any person’s name in the electoral rolls.
An objection to somebody’s name or for deletion of an individual’s own or any other person's name by applying in Form-7.
The Election Commission of India has made voter identification mandatory at the time of poll. Identification can be made with either Electors Photo Identity Card (EPIC) issued by the Commission or any other documentary proof as prescribed by the Commission.
